SUBCONTRACTOR TERMS & CONDITIONS
In these terms, unless the context otherwise requires, the following expressions shall have the following meanings:

"We," "Us," "Our," "The Contractor," "Housesandproperties," "Housesandproperties.com": refers to Housesandproperties.com (www.housesandproperties.com).

"You," "Your," "The Subcontractor," "The Photographer": refers to the subcontracted photographer.
1. Punctuality
You agree to arrive promptly at all scheduled appointments. If any delay is anticipated, you must inform us immediately.
2. Cancellations
If we cancel an appointment with less than 24 hours’ notice before the scheduled start time, we agree to pay 50% of the agreed fee for that appointment.
3. Client Communication
All client requests—verbal or written—must be directed to us via email at hello@housesandproperties.com. Any request made directly to you by the client is invalid and unenforceable unless confirmed by us in writing.
4. Professional Conduct
During appointments assigned by us, as confirmed via email or text, you are expected to represent Housesandproperties.com in a professional manner.
5. Non-Disclosure of Contact Details
You shall not disclose your personal contact details or accept contact details from our clients. All communications must be directed to us via:
6. No Client Promises
You shall not make any promises, representations, or agreements with the client. All client-related decisions must be approved by us in writing.
7. Contractual Appointments
Each appointment constitutes a binding contractual obligation beginning and ending at the specified times stated in the assignment confirmation.
8. Tax and Legal Compliance
You are an independent contractor and are solely responsible for managing your own financial obligations, including taxes, fees, and insurance.
9. Travel Responsibility
You are responsible for your own travel arrangements and expenses to and from each appointment location.
10. Entire Agreement
No verbal or informal agreement shall be binding. Any amendments must be in writing and signed by both parties.
11. Delivery Condition for Payment
We reserve the right to withhold payment until all deliverables (i.e., final images) have been received in full and in accordance with our requirements.
12. Payment Cap
We shall not be liable to pay you more than the amount agreed in writing for any engagement.
13. Limitation of Liability
We shall not be liable for:

Loss of profits or revenue

Damage to reputation or goodwill

Loss of opportunities or contracts

Third-party claims

Any indirect or consequential loss
14. Damage Liability
You are liable for any damage you cause to client property and agree to cover repair or replacement costs as deemed appropriate.
15. Entire Agreement
These terms constitute the entire agreement between the parties and supersede any prior agreements or understandings relating to the subject matter.
16. Quality of Work
You agree to complete all work to a professional standard, with due care and skill.
17. Travel Costs
You are solely responsible for all travel-related expenses, including but not limited to congestion charges, fines, fuel, and public transport fares.
18. Data Confidentiality
You shall not share any client contact information or other sensitive data with third parties without our prior written consent.
19. Image Delivery
Final images must be delivered to us within 12 hours of the job’s completion via WeTransfer or Google Drive.
20. Criminal Disclosure
You confirm you have no unspent criminal convictions and agree to disclose any past or pending criminal matters at the commencement of this agreement.
21. Photography Requirements
You shall photograph each property with a minimum of three exposures per shot, delivered in RAW format.
22. Brand Style Adherence
You confirm that you are familiar with the visual and stylistic requirements of Housesandproperties.com and will make every effort to align your work accordingly.
23. Restriction on Use of Images for Marketing
To prevent or mitigate brand dilution and client confusion, you shall not use any photographs, digital files, or related materials taken during appointments assigned by Housesandproperties.com for any marketing or promotional purposes, including but not limited to social media, personal or business websites, online portfolios, or advertising, without our prior written consent.
